Terms and Conditions of Sale

1. Introduction

The purpose of these general terms and conditions of enrollment (hereinafter referred to as the “Terms”) is to define the rights and obligations of the parties in connection with enrollment in the training programs of the Académie des Métiers de la Diplomatie (hereinafter referred to individually as the “training session”) offered by the AMD. These programs are listed on the AMD website at https://academiemetiersdediplomatie.org.

These Terms and Conditions shall govern the relationship between:

  • The Academy of Diplomatic Professions, hereinafter referred to as “AMD,”

and

  • The client and/or participant in a training session, hereinafter referred to as “client and/or participant”

2. Definitions

Client: the person responsible for paying for the training session. The Client may be either the participant or an institution wishing to allow one or more of its employees to participate in a training program.

Participant: a person who benefits from the training program.

Training: a skills development activity as defined in Article L.6313-1 of the Labor Code.

3. Scope

These Terms and Conditions of Sale are attached to the online application or the registration form for the Academy’s training programs, whether delivered via e-learning or in person.

These Terms and Conditions apply to customers and participants. Any registration via an online application or registration form, as well as any resulting payment, implies the unconditional acceptance of and full adherence to these General Terms and Conditions of Sale by the customer and the participant, who declare that they have fully read and understood them. These General Terms and Conditions of Sale will be supplemented by the training contract or agreement subsequently entered into between the participant and/or the customer and the AMD.

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect and shall be interpreted in accordance with the parties’ original intent.

AMD reserves the right to modify these terms and conditions at any time. In such cases, the terms and conditions applicable to the client and the participant will be those in effect on the date the participant registers for the training session.

4. Purpose (Registration and Contract Formation)

All applications for a training session must be submitted via the designated online form, which must be received by the AMD no later than twenty (20) business days before the start of the relevant training session. Registration is subject to the AMD selection committee’s approval of the application and the availability of spots in the relevant training session.

The application package or registration form must be submitted to the AMD either online or by email to the address listed in the description of the relevant training session, or by email to the following addresses: contact@academiemetiersdediplomatie.org and/or secretariat@academiemetiersdediplomatie.org

Registration for a training session—whether through an online application or a registration form—is subject to a possible review of applications by a selection committee within the AMD. Each participant will be notified by email at the address provided in their application or registration form regarding the AMD’s decision on their application. Subsequently, a training agreement, signed by the AMD, will be emailed to the client/participant. It is the sole responsibility of each participant to provide a valid email address and to check their inbox regularly. Subject to the conclusion and provisions of the training agreement, a participant is considered definitively enrolled in the relevant training session upon receipt of the confirmation email sent by the AMD as mentioned above, unless said participant withdraws from the training session or cancels their participation in accordance with Article 7 below.

Upon receipt of the training agreement, the participant and/or the client agree to sign it and return a copy to the AMD. These copies must be received by the AMD no later than ten (10) business days before the start of the relevant training session.

5. Information about training programs

For each training course, the AMD makes the following information available to the public before registration begins:

learning objectives, any prerequisites, delivery methods (in-person, distance learning, e-learning), methods for assessing learning outcomes, duration, detailed content and cost, wait times for access to the training, and contact information.

These items are included in the training programs available on the AMD website or provided upon request.

6. Financial Provisions

Payments may be made by bank transfer to the AMD’s account or by check—for customers or participants residing in France only—subject to the check being cashed. The AMD’s bank account information and the check’s payee are provided in the application packet or registration form. The AMD’s bank account information (RIB) can also be provided upon request to the secretariat: secretariat@academiemetiersdediplomatie.org

When registering for an online training course, the participant/client must pay the full training fee before the training session begins.

When registering for an in-person training course, the client/participant must pay the full training fee before the start of the session or make a down payment equal to 30% of the training fee at the time of registration. The balance of the training fee will be paid by the client/participant in accordance with the terms set forth in the training agreement or contract entered into with the AMD.

Prices are listed in euros.

AMD is not subject to VAT on training expenses in accordance with Article 261-4, paragraph 4, of the General Tax Code.

A payment receipt may be issued by the AMD upon the explicit request of the client or participant.

7. AMD’s Terms and Conditions for Postponement and Cancellation

In the event that the number of participants registered for a training session is deemed insufficient for educational purposes, the AMD reserves the right to postpone said training session no later than one week before the scheduled start date. In such cases, the client may either request a refund of the amount previously paid or request that this amount be applied toward payment for the rescheduled training session. In the event of a refund, the deposit will be refunded to the client within sixty (60) days of AMD’s receipt of the client’s bank account information.

A participant’s attendance at the training session is subject to availability. If, for any reason, the AMD is forced to deny the participant access to the training session, it agrees to reimburse the client.

8. Conditions for withdrawal and/or cancellation by the participant or customer

8.1. Right of Withdrawal

Pursuant to Article L.221-18 of the Consumer Code, any participant who is paying for their training out of their own pocket has fourteen (14) days from the date of final registration for the training session in question to withdraw and request cancellation of their participation in that training session.

The participant will then be reimbursed for any amount previously paid to the AMD under the terms of this agreement, provided that the request to withdraw was received by the AMD no later than ten (10) business days before the start of the relevant training session.

8.2. Cancellation

After the statutory withdrawal period has expired, when the participant is paying for the training out of their own pocket, any cancellation of participation in a training session—whether made by the client or by the participant—will result in the following financial consequences, which apply to the client or the participant who signed the agreement:

  • Cancellation thirty (30) calendar days or more before the start of the training session:
    No tuition fees will be due.
    If the client or participant does not wish to reschedule the training session under the conditions set forth in this article, they may request a refund of the amounts paid, excluding the registration fee, which is retained by the AMD.
    The refund will be issued within a maximum of sixty (60) days following AMD’s receipt of the client’s or participant’s bank account information;
  • Cancellation between thirty (30) and fifteen (15) calendar days before the start of the training session:
    the client or the participating signatory will be required to pay fifty percent (50%) of the total training fees as a cancellation fee, less any amounts already paid, excluding the non-refundable registration fee;
  • Cancellation fourteen (14) calendar days or less before the start of the training session, or cancellation during the training session:
    The full training fee will be due, and the registration fee shall, in any event, be retained by the AMD.

If applicable, the amounts paid by the client or the participating signatory may be applied toward the cost of another training session provided by the AMD, provided that registration for this new session occurs within twelve (12) months of the start date of the originally scheduled session.

In the event that this new training session is canceled, no further deductions or credits will be applied toward a future registration.

8.3. Terms and Conditions

Any request for withdrawal or cancellation must be submitted by email, with a request for acknowledgment of receipt, to the following address: secretariat@academiemetiersdediplomatie.org

If applicable, the client or participant who signed the training agreement or contract must submit, along with their request for withdrawal or cancellation, bank account information (RIB) to facilitate the reimbursement of any amounts owed by the AMD. Amounts owed by the AMD will be paid within a maximum of sixty (60) days following receipt of the corresponding bank account information.

9. Accessibility for People with Disabilities

The AMD is committed to reviewing any request to adapt training programs for people with disabilities.

10. Evaluation and Certification

Learning outcomes are assessed according to the procedures specified in the training program (quizzes, case studies, practical exercises, role-playing exercises).

At the end of the training, participants are given a certificate of completion.

11. Protection of Personal Data

Each client and participant in a training session will provide personal data as part of the information required on the online application or registration form. This personal data will be processed electronically.

The AMD will use this data in the course of its activities to register the participant for the training session and conduct it, manage the participant’s academic progress, verify the participant’s attendance in class, and enable the participant to take part, if applicable, in the field trips and study tour scheduled during the training session.

Pursuant to Law No. 78-16 of January 6, 1978, on Information Technology, Data Files, and Civil Liberties, participants have the right to access their personal data, a right they may exercise by contacting the personal data protection department at the following address: secretariat@academiemetiersdediplomatie.org. They also have the right to modify, correct, or delete any personal data concerning them, a right they may exercise by contacting the same department.

The AMD pledges not to disclose this data to third-party companies or institutions, with the exception of international institutions involved in the visits scheduled as part of the training session.

AMD is committed to addressing all complaints within a maximum of thirty (30) days.

13. Dispute Resolution and Mediation

13.1. Participants funding their training on their own (individuals)
In the event of a dispute that cannot be resolved amicably, participants funding their training on their own may seek the assistance of a consumer mediator, in accordance with Articles L.612‑1 et seq. of the Consumer Code.
The participant may use this mediator free of charge.
A consumer mediator will be appointed and the participant notified as soon as the Académie des Métiers de la Diplomatie (AMD) has joined a mediation organization listed by the Commission for the Evaluation and Control of Consumer Mediation (CECMC).

13.2. Institutional or Corporate Clients
For any dispute relating to the performance of a training agreement entered into with a legal entity (company, institution, or local government), the parties shall endeavor to reach an amicable resolution.
If no agreement is reached, the dispute shall be submitted to the competent courts in accordance with the provisions of the training agreement and French law.

13.3. General Provision
These provisions apply to all clients and participants who have signed a training agreement with the AMD.
